1. Acceptance of Terms

These Terms & Conditions (“Terms”) are a binding agreement between you and DriveSmartQuotes (“we,” “us”). By accessing or using drivesmartquotes.com and related services (the “Site”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

These Terms include a binding arbitration provision and class action waiver in Section 14.

2. Description of Services

DriveSmartQuotes is an online lead generator and marketing service. We collect information you submit and share it with third-party insurance providers, warranty providers and their partners (“Providers”) so they can contact you about auto insurance or vehicle service contracts.

• We are not an insurer, insurance agent or broker, or a warranty provider or administrator.
• We do not issue, bind or sell insurance or service contracts, and we do not give insurance, legal, tax or financial advice.
• We do not endorse any Provider, product, rate or plan. Any agreement you make is solely with the Provider.

3. Eligibility

You must be at least 18 years old, a resident of the United States, and able to form a binding contract. By using the Site you represent that you meet these requirements and that your use does not violate any law.

4. User Information

You agree to give accurate, current and complete information, and to submit requests only for yourself or with the authority of the person named. We may reject, remove or stop sharing information we believe is false, fraudulent or duplicated.

5. Electronic Consent (TCPA)

When you submit a request, you provide your electronic signature and express written consent to be contacted by DriveSmartQuotes and its marketing partners at the phone number and email you provided, including by autodialed calls, text messages and prerecorded or artificial voice messages, even if your number is on a Do Not Call list.

• Consent is not a condition of purchase.
• Message and data rates may apply. Message frequency varies.
• Reply STOP to any text to opt out, or reply HELP for help. You may also revoke consent by emailing support@drivesmartquotes.com.
• Revoking consent with us may not stop calls from Providers that already received your information; contact them directly as well.

6. Sharing with Partners

You authorize us to share the information you submit, including contact, vehicle, coverage and driving details, with Providers and other marketing partners, who may contact you and may use your information under their own privacy policies. We do not control Providers’ practices. See our Privacy Policy for how to limit sharing.

7. No Guarantee

We do not guarantee that any Provider will contact you, approve you, or offer coverage, or that any rate, price, discount or savings will be available. Offers, rates, eligibility and availability vary by Provider, state and your circumstances, and may change without notice.

8. Third-Party Links

The Site may link to or display third-party websites and offers. We do not control or endorse them and are not responsible for their content, products or privacy practices. You use them at your own risk.

9. Intellectual Property

The Site, including its text, graphics, logos and software, is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to view the Site for personal, non-commercial use. You may not copy, scrape, frame, reverse engineer or create derivative works from the Site without our written permission. “DriveSmartQuotes” and our logos are our trademarks.

10. Prohibited Conduct

You agree not to:

• submit false, fraudulent or another person’s information, or submit requests you do not intend to use;
• use bots, scrapers or automated tools, or interfere with the Site or its security;
• upload malware or attempt unauthorized access to our systems;
• use the Site unlawfully, or to harass, defame or harm others;
• resell or repurpose leads, Site content or data without our permission.

11. Disclaimer of Warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE. Content on the Site is general information, not advice. Verify all details directly with the Provider before you decide.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM YOUR USE OF THE SITE OR ANY DEALINGS WITH A PROVIDER. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO $100. Some jurisdictions do not allow certain limitations, so they may not apply to you.

13. Indemnification

You agree to defend, indemnify and hold harmless DriveSmartQuotes and its officers, employees and agents from claims, losses and costs (including reasonable attorneys’ fees) arising from your use of the Site, information you submit, or your breach of these Terms.

14. Arbitration and Class Action Waiver

Please read carefully. This section affects your legal rights.

Please allow 30 days for us to resolve it. If it is not resolved, any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration instead of court, except that either party may bring an individual claim in small claims court.

You and DriveSmartQuotes waive any right to a jury trial and to participate in a class, collective or representative action. Arbitration will be conducted by a recognized provider under its consumer rules, before a single arbitrator. If the class waiver is found unenforceable, this section is void as to that claim.

You may opt out within 30 days of first accepting these Terms by emailing support@drivesmartquotes.com with “Arbitration Opt-Out” in the subject line.

15. Governing Law

These Terms are governed by applicable law, without regard to conflict-of-law rules. Disputes not subject to arbitration may be brought in a court with jurisdiction over the parties and the dispute.

16. Changes to These Terms

We may update these Terms at any time by posting a revised version with a new “Last updated” date. Continued use of the Site after changes means you accept them.

17. Termination

We may suspend or end your access to the Site at any time, with or without notice, if we believe you violated these Terms or the law. Provisions that by nature should survive termination (including Sections 5–6, 9–15) will survive.
